Terms of Service

⚠️ This Terms of Service is a draft and must be reviewed by a qualified Australian healthcare/pharmaceutical lawyer before use with real patients.
These Terms of Service ("Terms") govern your use of Dava ("we", "us", "our"), the technology platform accessible at dava.net.au. By creating an account or subscribing, you agree to these Terms. If you do not agree, do not use Dava. These Terms are governed by the laws of Queensland, Australia.

1. What Dava is — and is not

Dava is a technology platform, not a pharmacy. Dava facilitates access to a licensed pharmacy partner's dispensing services. All dispensing of prescription medicines is performed exclusively by our registered pharmacy partner operating under a Queensland Pharmacy Business Licence, supervised by AHPRA-registered pharmacists.

Dava does not dispense medicines, hold pharmacy stock, make clinical decisions, operate as a pharmacy, or provide medical advice. Nothing on the Dava platform constitutes medical advice. Always consult your prescribing doctor or pharmacist for clinical guidance.

2. Eligibility

To use Dava you must:

  • Be 18 years of age or older (or have parent/guardian consent if using a Family plan for a minor).
  • Be an Australian resident.
  • Hold a valid Australian electronic prescription (e-prescription) for any prescription medicines you wish to order.
  • Provide accurate, complete, and current account information.

3. Prescription medicines — critical disclosures

E-prescription requirement: A valid Australian electronic prescription token or Active Script List (ASL) authorisation is required for every prescription medicine order. Paper prescription photographs are not accepted as a primary pathway. Dava will not process any order without pharmacist verification of a valid prescription.

S8 and S9 medicines: Schedule 8 (controlled drugs, including opioids and certain benzodiazepines) and Schedule 9 (prohibited substances) are absolutely excluded from the platform and cannot be ordered under any circumstances.

PBS disclosure — important: Dava facilitates private dispensing of prescription medicines. This means:

  • Purchases dispensed privately through Dava do not count toward your PBS Safety Net threshold.
  • A PBS-dispensed alternative may be available from a standard pharmacy. Your pharmacist will advise you of the PBS option and its cost.
  • PBS co-payments (currently $7.70 concession / $31.60 general as of 2026) cannot be paid through Dava's subscription model.
  • Concession card holders are encouraged to consider whether PBS dispensing at a standard pharmacy better suits their circumstances.

Dispensed medicines cannot be returned: Once a prescription medicine has been dispensed and dispatched, it cannot be returned or refunded. This is a requirement under TGA regulations.

4. Subscriptions and billing

Subscription fee: Your chosen subscription tier is billed annually in advance via Stripe. The subscription fee covers platform access and scheduled prescription delivery services. Delivery fees are charged separately at the time of each dispatch.

Auto-renewal disclosure (ACCC 2025 compliant): Your subscription automatically renews at the end of each annual period at the then-current rate. We will send you reminder emails 30 days and 7 days before your renewal date. You can cancel at any time — see Section 5.

Price changes: We will give you at least 30 days' notice of any price increase before your next renewal date. You may cancel before the renewal if you do not accept the new price.

Failed payments: If a payment fails, Stripe will automatically retry up to three times. If payment remains unsuccessful, your subscription will be suspended and you will be notified.

Delivery fees: Standard delivery: $6.95. Express delivery: $12.95. Free delivery threshold applies to OTC-only orders over $80.

5. Cancellation — one tap, no dark patterns

You may cancel your Dava subscription at any time. Cancellation takes one tap. No phone calls, no retention mazes, no requiring you to contact support. This complies with ACCC subscription reform guidance (in force July 2025).

To cancel: go to Account → Subscription → Cancel subscription → confirm once. Your access continues until the end of your current paid period. You will receive a confirmation email immediately.

Refunds on subscription fees: We offer a pro-rata refund for the unused portion of your annual subscription if you cancel within the first 30 days. After 30 days, subscription fees are non-refundable. This does not affect your rights under the Australian Consumer Law.

Cooling-off and dispensed medicines: The standard ACL cooling-off right applies only to the subscription service fee — not to prescription medicines already dispensed and dispatched, which cannot be returned under TGA regulations.

6. OTC marketplace

The Dava OTC marketplace sells Schedule 2 (S2) and Schedule 3 (S3) over-the-counter pharmacy products and general health products. ACL consumer guarantees apply to all OTC products. All health claims comply with the Therapeutic Goods Advertising Code 2021.

OTC returns: OTC products may be returned for a full refund within 30 days of receipt if unopened and in original condition. For faulty or incorrectly described products, the usual ACL consumer guarantee period applies. See our Refund Policy for the full process.

7. Acceptable use

You agree not to:

  • Provide false or fraudulent prescription information.
  • Attempt to obtain Schedule 8 or Schedule 9 medicines through the platform.
  • Share your account with others or allow others to use your prescription subscription.
  • Use Dava for any unlawful purpose.
  • Attempt to circumvent platform security, rate limits, or access controls.
  • Use automated tools to access the platform except as expressly permitted by us.

8. Limitation of liability

To the maximum extent permitted by Australian law, Dava's liability to you is limited to the total subscription fees you paid in the 12 months before the claim arose. Dava is not liable for: indirect or consequential loss; loss of data; any clinical harm arising from a prescriber's or pharmacist's professional decisions; or delivery delays caused by Australia Post or other carriers outside our control.

Nothing in these Terms limits any guarantee, right, or remedy under the Australian Consumer Law that cannot be excluded or limited by law.

9. Changes to these Terms

We may update these Terms. We will notify you of material changes by email at least 30 days before they take effect. Continued use of Dava after the effective date constitutes acceptance of the updated Terms.

These Terms are governed by the laws of Queensland, Australia. Disputes that cannot be resolved through our complaints process may be referred to the Queensland Civil and Administrative Tribunal (QCAT) for consumer matters.
